Alec Baldwin’s involuntary manslaughter charge in the fatal shooting of Rust cinematographer Halyna Hutchins has been downgraded.

Prosecutors for the Santa Fe County District Attorney in New Mexico dropped a five-year gun enhancement linked to Baldwin’s indictment, significantly reducing his possible sentence if convicted, according to filings Feb. 17 and shared by E! News.

The five-year firearms upgrade was also dropped against Rust gunsmith Hannah Gutierrez-Reed, who faces the same involuntary manslaughter charge as Baldwin in connection with Hutchin’s death.

The legal change comes a week after Baldwin’s attorneys filed a motion to remove the improvement. According to one of E! In the Feb. 10 news, the actor’s legal team accused prosecutors of charging him with a firearm enhancement that was not true at the time of the shooting.

“Prosecutors made a fundamental error of law in charging Mr. Baldwin under a version of the Firearms Enhancement Act that did not exist at the time of the accident,” the court document said. “So it appears that the government intended to impeach the current version of the Weapons Improvement Act, which was only enacted on May 18, 2022, seven months after the accident.”
